Heard learned counsel for the petitioner.
The petitioner is apprehending his arrest in connection with Khusrupur P.S. Case No. 182 of 2016 registered for the offences punishable under Sections 354A and 354B of the Indian Penal Code.
Allegation against the petitioner that he has tried to raise the modesty of the informant as also harassing her in drunken condition.
It has been submitted on behalf of the petitioner that the whole prosecution story is false and concocted, which is evident from the statement of witnesses in paragraphs 24 and 25 of
Patna High Court Cr.Misc. No.14915 of 2017 (5) dt.12-05-2017 2/3 the case diary that petitioner was dealing with gold business and there was some dues against father of the informant and he had not paid the same, as such, the false case has been filed. Heard learned APP also, who has not controverted the above submission.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, named above, in the event of his arrest or surrender in the court within a period of two weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Patna City, in connection with Khusrupur P.S.Case No. 182 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that bailors of the petitioner should be local persons having sufficient immoveable properties within the jurisdiction of the court concerned and petitioner shall co-operate in the investigation and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of his bail bonds and further
Patna High Court Cr.Misc. No.14915 of 2017 (5) dt.12-05-2017 3/3 petitioner will not induce any witness or tamper with the evidence and if any incriminating materials has come against the petitioner during course of investigation, the prosecution will be at liberty to move for cancellation of his bail bonds.
