From the show cause filed by the respondents and the orders contained in Annexure-B from page -13 onwards of the show cause it is seen that gratuity and various other claims as are detailed in the order have been paid to the petitioner and with regard to certain other claims to be settled it is stated that there being serious dispute that an F.IR. has been lodged it could not be settled. Thereafter the
Patna High Court MJC No.4391 of 2014 dt.05-01-2018 2/2 petitioner was required to file an affidavit for settlement of her claim. Even though the show cause has been filed on 10.12.2014 there is no rebuttal by the petitioner to the show cause till date and when the matter is taken up no one appears on behalf of the petitioner consistently for more than three occasions. Being satisfied with the averments and enclosures thereto in the show cause as contained in Annexure-B from page 13 onwards, I am not inclined to proceed further in the matter.
In case the petitioner has any grievance with regard to her claim persists, liberty shall be available to her to initiate fresh proceeding inspite of the fact and circumstances and conduct of the petitioner that she did not rebut to the show cause which was filed on 10.12.2014. That apart, the petitioner claims that the requirement called for in Annexure-B may be considered in accordance with law. The application stands disposed of accordingly.
