Petitioner seeks bail in Town P.S. Case No. 280/18 registered for the offence under Sections 341, 307, 324, 326/34, 302 of I.P.C.
Allegation as per the F.I.R. is of assault to the informant by the knife by the son of petitioner and petitioner who happens to be the wife of the informant caught hold of informant. Later on informant succumbed to the injuries.
Submission on behalf of the learned counsel for the petitioner is that the petitioner has not assaulted the informant and, as matter of fact, the informant had come in drunken state and scuffle took place between the son and the husband of the
Patna High Court Cr.Misc. No.64869 of 2018 (2) dt.02-11-2018 2/2 deceased and it is the son who stabbed. Sh1e is in custody since 17.05.2018.
. Heard the learned A.P.P. also. Having heard both sides and in view of the facts and circumstances of the case, stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Motihari, East Champaran, in Motihari Town P.S.Case No.280 of 2018 with condition that bailers must be of local having sufficient immoveable properties within jurisdiction of the court concerned.
