JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 The petitioner seeks regular bail in connection with Saharsa Mahila P.S. Case No. 19 of 2016, registered for offences punishable under Sections 341, 376, 511 and 506 of the Indian Penal Code.

Allegation as per F.I.R. is that petitioner undressed the informant and tried to commit rape with her.

It has been submitted on behalf of the petitioner that he is the neighbour of the informant and has falsely been made accused in this case and no occurrence as alleged has ever taken place, which will appear from the fact that the F.I.R. has been lodged after delay of six days. Further he has no criminal antecedent and has been in judicial custody since 12.07.2018. Heard learned A.P.P. also.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -Ist -cum-Special Judge, Saharsa, in connection with Saharsa Mahila P.S. Case No. 19 of 2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
