Learned counsel for the State referring to the Annexure R-2/5 of the counter affidavit submits that the petitioner was removed from the post of Aanganbari Sevika on the ground that she had furnished forged and fabricated marksheet showing higher marks as 413 instead of 400. The removal of the petitioner was upheld by the learned District Magistrate in appeal vide order dated
Patna High Court CWJC No.21008 of 2014(3) dt.30-01-2023 2/2 29.10.2012 which was challenged by the petitioner in earlier writ petition bearing CWJC No. 22338/2012 which got dismissed on merit by this Court vide order dated 04.03.2014. The petitioner has filed the present writ application concealing the aforesaid fact that the petitioner had challenged the same impugned order in previous writ petition which got dismissed on merit.
In view of the submission made by the learned counsel for the State, this writ application is dismissed on the ground of concealment of material fact by the petitioner with cost of Rs. 5000/-, to be deposited in the account of Patna High Court Legal Services Committee.
