JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-09-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 302/34/201 and other ancillary sections of the Indian Penal Code.
Three FIR named accused persons called out brother of the informant and took him away and later on his dead body was recovered.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR and the only material collected during investigation is that petitioner was found talking with one of the co-accused at the relevant time. From the mobile phone of this petitioner some calls had also been made to the deceased.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II Samastipur in Police Station Case No. 427 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
