JUSTICE SUDHIR SINGH ORAL ORDER 13-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Karpi P.S. Case No. 192 of 2015 for the offences instituted under Sections 457, 380 and 411 of the IPC. The prosecution story, in brief, is that in between the night of 20.11.2015 and 21.11.2015, some unknown thieves committed theft of apparatus of Computer Lab in total value Rs.85,000/- from the School.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners.

Patna High Court Cr.Misc. No.6937 of 2017 (2) dt.13-02-2017 2/2 They are not named in the FIR. The name of the petitioners has come on the basis of confessional statement of the co-accused Sunil Kumar. The theft articles are said to have been recovered from possession of said co-accused Sunil Kumar. There is no recovery of any incriminating article from possession of the petitioners. Other co-accused has been granted anticipatory bail by the learned court below vide A. B. P. No. 86 of 2016. On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Karpi P.S. Case No. 192/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jehanabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
