Petitioner, who is in custody, seeks bail in connection with Brahmpura P.S. Case No. 46 of 1998 arising out of Complainant Case No. 272 of 1998 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Informant who is the son of the deceased has alleged that petitioner along with other co-accused persons killed his father due to non payment of ransom. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been
Patna High Court Cr.Misc. No.66306 of 2018(2) dt.20-11-2018 2/2 falsely implicated in this case to earn money. Father of the informant has died due to electric current. He is 76 years old man. He has no criminal antecedent. He is in custody since 23.07.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Brahmpura P.S. Case No. 46 of 1998.
