2. The petitioner seeks regular bail in connection with Vijayepur P.S. Case No. 25 of 2024 registered on 12.02.2024 lodged under Sections 341, 323, 324, 307, 354B of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against ten named accused persons against whom there is general and omnibus allegation that they have surrounded the house of the informant and assaulted on the head of the informant by Farsa on which she got injured.

4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that from the content of the F.I.R., it becomes crystal clear that the scuffling took place due to land dispute as mentioned in the F.I.R. He further submits by virtue of the alleged assault injury took place

Patna High Court CR. MISC. No. 23985 of 2024(2) dt.04-04-2024 2/2 and injury report which is annexed as Annexure-P3 indicated that injury is simple in nature. Counsel further submits that for the same date and place of occurrence, there is case and counter case. The present case has been filed by the informant against the petitioner whereas petitioner has filed Vijayepura P.S. Case No. 26 of 2024 against the informant side. Counsel further submits that petitioner is in custody since 14.02.2024 having no criminal case pending against him.

5. Learned counsel for the State opposes the prayer for bail.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Vijayepur P.S. Case No. 25 of 2024 subject to the following conditions as well as the conditions laid down under Section 437 (3) of the Cr.P.C.
