JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-11-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 18.04.2016 passed in Cr. Misc. No. 10060 of 2016 on the ground that the petitioner is suffering in custody since 15.10.2015 having clean antecedent, there is no direct evidence against the petitioner, the confessional statement made before the police has got no evidentiary value in the eye of law, the owner book of motorcycle of the deceased has been implanted by the police resulting the petitioner is suffering in custody, to which the learned A.P.P. opposes. In the facts and circumstances as stated above, finding no good ground for reconsideration of prayer for bail, again prayer

Patna High Court Cr.Misc. No.47158 of 2016 (2) dt.16-11-2016 2/2 for bail of the petitioner stands rejected in connection with S.T. No. 73 of 2016 arising out of Bahadurganj P.S. Case No. 283 of 2015/ G.R. No. 1653 of 2015 pending in the court of the learned Sessions Judge, Kishanganj.

However, considering detention of the petitioner, let the trial be expedited and concluded as early as possible preferably within a period of five months from the date of receipt/production of a copy of this order.
