20-12-2016 Heard Sri Ratnakar Jha, learned counsel for the petitioner, learned Addl. Public Prosecutor as well as Sri Arvind Kumar Sinha, learned counsel, who intends to file vakalatnama on behalf of complainant/opposite party no. 2.

The petitioner, husband of the complainant/opposite party no. 2, has approached this Court, with a prayer to extend the privilege of anticipatory bail in C. R. No. 338 (CR) of 2016 registered for offence under Sections 323, 379 & 498(A) of the Indian Penal Code and Sections 3 & 4 of the Dowry Prohibition Act, 1961.

At the very outset, learned counsel for the petitioner, by way of referring to statement made in paragraph - 11 of the

Patna High Court Cr.Misc. No.54573 of 2016 (2) dt.20-12-2016 2/2 present petition, submits that petitioner, being husband of complainant, is still ready to keep her as wife with full dignity and honour.

However, Sri Arvind Kumar Sinha, learned counsel, who has entered appearance on behalf of complainant/opposite party no. 2, submits that the wife does not want to live with the petitioner and she wants one time settlement. The Court is of the opinion that regarding settlement, the complainant may avail appropriate remedy. So far as prayer for grant of anticipatory bail is concerned, in view of facts and circumstances, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Arvind Kumar Singh @ Sonu Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Vivek Vishal, learned Judicial Magistrate 1st Class, Madhubani in connection with C.R. No. 338 (CR) of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) Anay U T
