JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-04-2019 Heard learned Counsel for the parties concerned. The order, dated 04.09.2018, passed by the Commissioner, Tirhut Division, Muzaffarpur, in BLDR Appeal Case No. 138 of 2018, is under challenge, whereby he has dismissed the petitioner's appeal on the ground of delay. The appeal was filed by the petitioner nearly two years after the order was passed.

The petitioner has statutory remedy under the Bihar Land Mutation Act, 2011, which he has not availed.

The petitioner shall be at liberty to take, before the Tribunal, such plea for condonation of delay in filing the application before the Tribunal as may be available to him, including the plea that he was pursuing his remedy before this Court by filing the present application.
