During the hearing of the petition, it emerges that some payments have been made out of the cheque amount which is said to have bounced due to insufficiency of the fund. The commission of the offence is not disputed under the facts of the case. However, the learned counsel appearing for the petitioner expressed his clients desire to settle the dispute amicably. Let the trial court explore the possibility and if the parties settle their accounts out of the Court and the Court is satisfied about it, then the Court shall attempt to dispose of the case favourably to the petitioner on compromise within a period of one month of being informed about the settlement. Patna High Court Cr.Misc. No.4531 of 2013 (3) dt.04-05-2015 proceedings which was stayed by order passed on 04.07.2013 is hereby vacated.
