In this case, the petitioner is seeking bail in Sirdala P.S. Case No. 417 of 2019 registered for offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act, 2016. As per allegation, 135 liters of foreign liquor was recovered from a vehicle, however, counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner and he has been implicated in the present case as being owner of the said vehicle. It is urged that the petitioner is in custody since 15.02.2020. It is claimed that his antecedent is clean.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail
Patna High Court CR. MISC. No.19301 of 2020(5) dt.12-08-2020 2/2 on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-II-cum-Special Judge, Nawada in connection with Sirdala P.S. Case No. 417 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
