JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-05-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. It appears that a clash between the two groups gave rise to two criminal cases being Shakurabad P.S. Case No. 72 of 2014 and Shakurabad P.S. Case No. 73 of 2014. The petitioners, in the present application seeking anticipatory bail, have been made accused in Shakurabad P.S. Case No. 73 of 2014 registered for the offences punishable under Sections 147, 148, 149, 323, 354, 379 and 427 of the Indian Penal Code.

Patna High Court Cr.Misc. No.46859 of 2014 (2) dt.07-05-2015 2/2 Learned counsel appearing on behalf of the petitioners has drawn my attention to the First Information Report lodged by the petitioners' side with respect to the same occurrence said to have taken place on the same date and time and has submitted that, as a matter of fact, the informant's side of the present case were the aggressor and in the said clash, the petitioners' side received injuries. He has submitted that no injury has been alleged to have been caused by these petitioners as per the First Information Report.

In view of the submission as above, let the petitioners abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Shakurabad P.S. Case No. 73 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
