The petitioner seeks bail in connection with POCSO Case No. 11 of 2018 arising out of Ballia P.S.Case No. 163 of 2015 registered under Section 341, 323, 363, 366A, 368, 370A, 370D, 372, 373 and 120B/34 of the Indian penal Code, Sections 3, 4, 5, 6, 7, 8 and 9 of the Immoral Traffic Act and also Sections 4 and 8 of the POCSO Act.

It is alleged in the written report that police, on getting information that one Kalo Khalifa, along with his other family members, has kept a minor girl in his house and doing business of immoral trafficking at Mathurapur Red Light Area, raided the house of Kalo Khalifa. On seeing the police party, all accused persons present there tried to escape, but with the help of

Patna High Court Cr.Misc. No.63540 of 2018(2) dt.11-10-2018 2/3 Chowkidar, namely, rizwana Khatoon, two minor girls, namely, Neha Kumari and Gita Kumari were apprehended. They disclosed that Lalo Devi has brought them from Muzaffarpur. They further disclosed that Kalo Khalifa, his brother K.R.Khalifa, Samser Khalifa, Ranjeet Khalifa, Sajni Devi, Soni Devi, Minu Devi, Rinu Devi and Lalo Devi along with 2-3 unknown persons have forced them to indulge in prostitution. All of them took share of income of the prostitution in the night. Both of them were kept in the house of Kanku Yadav. It is further alleged that cash of Rs. 200/- and 250/- were recovered with Neha Kumari and Geeta Kumari.

After recovery, statements of Neha Kumari and Geeta Kumari, under Section 164 Cr.P.C. have been recorded, which have been enclosed as Annexure-2 series. The recovered girl Geeta Kumari in her statement has not taken the name of this petitioner. The other girl Neha Kumari has taken the name of this petitioner along with other co-accused namely K.B.Khalifa, Soni Devi, Shamsher Khalifa, Kalo Khalifa and Sajni Devi. It is submitted that similarly situated co-accused namely K.B.Khalifa and Shamsher Khalifa, whose name has been taken by Neha Kumari, have been granted bail by a co-ordinate Bench of this court as well as by this Court in Cr. Misc. No. 7194 of

Patna High Court Cr.Misc. No.63540 of 2018(2) dt.11-10-2018 3/3 2018 and Cr. Misc. No. 51110 of 2018 vide order dated 28.02.2018 and 27.09.2018 respectively and this petitioner is in custody since 30.08.2018.

Considering the aforesaid fact and circumstances, the prayer of bail of the petitioner is allowed. The petitioner, abovenamed, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st , Begusarai in connection with Ballia P.S. Case No. 163 of 2015 with condition that both the bailors will be the close relative of the petitioner.
