JUSTICE SANJAY KUMAR ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.
The petitioner seeks regular bail in connection with Parsa Bazar P.S. Case No. 160 of 2016 registered for the offences punishable under Sections 3, 4 and 5 of the Immoral Traffic Act.
Four persons were apprehended by the police while they were indulged in Immoral act.
Learned counsel for the petitioner submits that out of four, two co-accused have been allowed bail vide order dated 06.10.2016 and 20.10.2016 passed by another co-ordinate Bench of this Court in Criminal Miscellaneous No. 44653 of
Patna High Court Cr.Misc. No.5999 of 2017 (2) dt.22-02-2017 2/2 2016 and 45564 of 2016. The petitioner has been apprehended by police merely on suspicion and he is in custody since 28.08.2016, having no criminal antecedent.
Learned APP for the State opposed the submission. Considering the nature of allegation against the petitioner and the fact that similarly situated co-accused have already been granted the privilege of bail, the prayer of bail of this petitioner is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Parsa Bazar P.S. Case No. 160 of 2016.
