Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.
The petitioner is husband of the victim of dowry death. Petitioner is in custody since 20.12.2017. In the past, prayer for bail was refused on 08.05.2018 vide Annexure-1 with direction to expedite the trial and conclude the same preferably within nine months.
Report of the learned trial Judge dated 17.05.2019, would reveal that up-till-now no prosecution witness has turned up.
Considering the fact that there is no chance of conclusion of trial in near future, let the petitioner, above
Patna High Court CR. MISC. No.20677 of 2019(3) dt.26-06-2019 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bodh Gaya Police Station Case No. 140 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
