JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-05-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Mashrakh P.S. Case No. 137 of 2019 for the offence under Sections 272, 273 of the Indian Penal Code and Sections 30 and 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 06.03.2020. He further submits that in the instant case total 315 litres of country made liquor was seized from an orchard (open place).

Considering the fact that the petitioner has got no criminal antecedent and the liquor was not recovered from the conscious possession of the petitioner, the petitioner, named above, is directed to be released on his personal bond to the
