Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 30(a) of the Bihar Prohibition & Excise Act. 18 liters Indian made foreign liquor is said to have been recovered from conscious possession of the petitioner and supplementary affidavit fled on behalf of the petitioner goes to show that prior to institution of the present case, one case i.e. Buxar Town P.S. Case no. 244/2017 was registered against the petitioner for violation of Bihar Prohibition & Excise Act. Petitioner is in jail custody since 31.8.2018.

Patna High Court Cr.Misc. No.65997 of 2018 (2) dt.22-11-2018 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Special Judge Excise, Bhojpur at Ara in Excise case no. 1377/2018 arising out of Ara Rail P.S. Case no. 73/2018.
