This is an Appeal preferred against order dated 21st December 2011 passed by Railway Claims Tribunal, Patna Bench in Claim Application No. 0A 00079/2002 wherein the claim of the appellants was allowed with interest from the date of order. Undisputedly, entire payment has been received well within time but this Appeal has been preferred only for the interest accruing from the date of filing of the application till date of order. Surprisingly enough this Appeal has been filed after a year and quarter beyond limitation, there appears no reason to condone the delay and matter appears consequently covered by a decision of this Court rendered in the case of Rajendra Prasad @ Rajendra Mahto vs. The Union of Indian through the General Manager, Eastern Railway, Kolkata in M.A. No. 512 of 2013.
Patna High Court MA No.515 of 2013 (9) dt.06-01-2015 2/2 Hence, Interlocutory Application No.6707 of 2014 seeking condonation of delay in filing of the Appeal appears devoid of any merit. Hence, it is dismissed consequently, the Appeal also stands dismissed.
