The petitioner seeks bail in Pupari P.S. case No. 188 of 2016 under Section 364, 365, 366A of the Indian Penal Code. The father of the victim filed complaint case on the basis of which the present FIR was registered. The informant alleged that petitioner with the help of other accused persons enticed his minor daughter.
The learned counsel for the petitioner submits that the victim made her statement under Section 164 of the Cr. P. C. and she disclosed that petitioner along with other accused persons took her to Madras but she did not allege misbehaviour at the hands of the petitioner. The victim appears to be major and she voluntarily accompanied the petitioner to different places as it

Having considered the fact that, of course, the victim made her statement under Section 164 of the Cr. P. C., after more than two years, and she disclosed that petitioner took her to different places and kept her confined but the victim did not make any allegation that petitioner ill behaved with her, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Pupari P.S.
