JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The application is for grant of anticipatory bail in connection with Amba P.S. Case No. 12 of 2017 registered for offence under section 30A of the Bihar Prohibition and Excise Act.

It has been submitted on behalf of the petitioner that the petitioner is owner of the Tempo and except that there is nothing against him.

Considering section 76 (2) of the Bihar Prohibition and Excise Act, 2016, this Court is not inclined to grant anticipatory bail to the petitioner, however he may surrender before the court below and make prayer for regular bail, which will be considered by the court below on its own merit, without being prejudiced by this order.

Patna High Court Cr.Misc. No.9931 of 2017 (2) dt.06-03-2017 2/2 Accordingly, this petition is disposed of.
