The petitioner seeks bail in S.T. No. 107/2018, arising out of Madhepura (Bharrahi O.P.) P.S. Case No. 671/2015, instituted for the offences under Sections 399, 402, 414 and 34 of the Indian Penal Code read with Sections 25(1-B)a, 26 and 35 of Arms Act.
It is alleged in the written report that police got information that this petitioner with other accused are making plan for committing crime. It is alleged that four persons were apprehended by the police and three managed to run away. From their possession firearms were recovered. One of the apprehended accused, namely, Bauwa Rai disclosed the name of this petitioner.
Patna High Court Cr.Misc. No.65559 of 2018 (2) dt.02-11-2018 2/2 Learned counsel for the petitioner has submitted that other apprehended accused persons have already been granted bail by co-ordinate Benches of this Court. Copies of the orders have been annexed as Annexure-2.
Petitioner is in custody since 17.02.2018.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Madhepura in connection with Madhepura (Bharrahi O.P.) P.S. Case No. 671/2015, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J.) Rakhi U T
