Petitioner seeks bail in Kotwali P.S. Case No.427 of 2018 instituted for the offence under Section(s) 290, 354-D/34 Indian Penal Code and Section 27 of the NDPS Act. Counsel for the petitioner submits that there is no recovery of any narcotic article from the possession of the petitioner. The police arrested two persons, namely, Kaushal Kumar and Rajesh Kumar and recovered Ganja from their possession. They disclosed name of this petitioner along with other accused persons. The police made search of the petitioner but did not recover any incriminating article from his possession. It has been submitted that co-accused, namely,

Patna High Court Cr.Misc. No.66163 of 2018 (2) dt.05-11-2018 2/2 Rajesh Kumar Jha and Kaushal Kumar, have been granted bail by co-ordinate Bench of this Court by order dated 06.10.2018 passed in Cr. Misc. No.56634 of 2018.

Petitioner is in custody since 10.07.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Patna, in connection with Kotwali P.S. Case No.427 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
