JUSTICE PARTHA SARTHY ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner who is in custody since 24.12.2019 has filed the instant application for grant of regular bail in connection with Panjwara P.S. Case no. 18 of 2019 registered under section 392 of the Indian Penal Code. As per allegation in the FIR, two accused persons forcibly took away Rs. 8000-9000 from the informant and also assaulted him. They also took away his mobile phone.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. Inspite of the petitioner being in custody since 24.12.2019, he has not been put on TI parade and charge sheet has been submitted in the case. No incriminating article has been recovered from his possession and he has no criminal antecedent.

The application for bail is opposed by learned APP for the State.

No.19175 of 2020(2) dt.04-06-2020 2/2 Having heard learned counsel for the parties and in view of the fact that the petitioner has no criminal antecedent and in spite of being 24.12.2019 has not been put on T.I. Parade, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Panjwara P.S. Case no. 18 of 2019 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Banka.
