The petitioner seeks bail in Arah Rail P.S. Case No. 86/2016, registered for the offences punishable under Section 414 of the Indian Penal Code.

The petitioner was apprehended on the railway platform and from his possession different stolen articles and ornaments etc. were recovered.

Learned counsel for the petitioner submits that the case is reported about the theft recovered articles from the possession of the petitioner. Theft recovered articles were not put on Test Identification Parade. Petitioner is in jail since 29.09.2016 and he has got no criminal antecedent.

Considering the facts aforesaid and the fact that the

Patna High Court Cr.Misc. No.55617 of 2016 (3) dt.02-03-2017 petitioner has already remained in jail for more than five months, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Arah in connection with Arah Rail P.S. Case No. 86/2016.
