JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2019 At the very outset it is submitted by the learned counsel for the petitioners that during the pendency of the instant application, petitioner no.1 is arrested by the police. In such view of the matter, the application against petitioner no.1 is dismissed as withdrawn.
This is an application for grant of anticipatory bail in connection with Suppi P.S. Case No. 02 of 2018, disclosing offences under Sections 363, 366A, 376, 34 of the Indian Penal Code and Section 4/8 of POCSO Act.
There is allegation of kidnapping of minor daughter of the informant by the petitioners and also of committing rape. Submission of the learned counsel for the petitioner is that the statement of the victim girl has been recorded and she
Patna High Court CR. MISC. No.20820 of 2019(4) dt.19-06-2019 2/2 has not supported the prosecution version either of rape or of kidnapping and the age of the girl has been assessed 17 years by the Medical Board. However, she has not appeared for medical examination and as such, there is no injury report on the record. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner no.2, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.D.J.-1st, Sitamarhi, in connection with Suppi P.S. Case No. 02 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
