JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 147, 149, 341, 323, 325, 307, 504 and 506 of the Indian Penal Code.

Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that there is general and omnibus allegation against the petitioner and specific allegation of assault is against other co-accused person and after investigation he has not been sent up for trial. Cognizance has been taken under Section 308 and other Sections of the Indian Penal Code.

No.8769 of 2017 (2) dt.01-03-2017 2/2 Having heard both sides, in view of the fact that specific allegation is upon other co-accused and not against the petitioners, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Sadar, Motihari, East Champaran, in connection with Pipra P.S. Case no. 279 of 2014 (G.R. no. 6153 of 2014) subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned,

(2) petitioners shall cooperate in the investigation and make themselves available before the police as and when required. (Vinod Kumar Sinha, J) sudip/- U T
