====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-09-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of bail in Chhatauni P.S. Case no. 184/2020 registered for the offence punishable under sections 325, 379, 307, 506 and other allied sections of the Indian Penal Code.
As per prosecution case, this petitioner assaulted the informant with iron rod on his head as a result of which he sustained multiple injury.
It is submitted on behalf of petitioner that there is case and counter case and both sides sustained injuries. As per injury report no offence under section 307 IPC is made out. Petitioner is in custody since 18.12.2020. Charge sheet has already been submitted.
Patna High Court CR. MISC. No.30235 of 2021(3) dt.27-09-2021 2/2 Learned counsel for the State opposed the prayer for bail and submitted that this petitioner assaulted the informant as a result of which he sustained multiple injury. Considering the nature of accusation and number of injuries sustained by the informant, prayer for bail of the petitioner is rejected.
However, once charge is framed and trial commences, the petitioner shall be released on bail by the learned trial court on its own satisfaction and on the condition that he will cooperate in disposal of trial and appear before the trial court, as and when required.
