The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner assaulted with iron rod on the head of one Shyam Sundar Tiwari. It is submitted that petitioner has been falsely implicated in this case due to land dispute pending between the parties. There is case and counter case. Petitioner claims clean antecedents.

Counsel for the State opposed the prayer for bail and submitted that this petitioner caused grievous injury to the injured.

Considering the facts aforesaid and nature of injury, I

Patna High Court CR. MISC. No.23345 of 2023(2) dt.26-06-2023 2/2 am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Kargahar P.S. Case No. 466 of 2022. Accordingly, the same is rejected.
