JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-363, 365 of the Indian Penal Code.
Petitioner happens to be driver of a tempo and it is alleged that the victim was working with the petitioner. It is further alleged that on 16-07-2015, the victim was taken away by the petitioner but thereafter, the victim did not return to his home and when the informant inquired from the petitioner about the whereabouts of the victim, the petitioner did not give any satisfactory answer.
Perusal of the case diary goes to show that the aforesaid fact has been reiterated by some witnesses. The
Patna High Court Cr.Misc. No.37298 of 2016 (3) dt.15-11-2016 2/2 investigation against the petitioner has already been completed. The victim is still traceless but taking note of the aforesaid fact as well as this aspect of the matter that the petitioner is languishing in jail custody since 19-01-2016 without having any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Singheshwar P.S. Case No. 121 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Madhepura.
