Petitioner seeks bail in Wazirganj P.S. Case No.249 of 2018 instituted for the offence under Section(s) 414 Indian Penal Code.

Counsel for the petitioner submits that as per written report one Mantu Kumar was arrested with motorcycle. He disclosed the name of Randhir Kumar from whose possession motorcycle has been recovered. It is further alleged that police also recovered motorcycle from the possession of Pramod Kumar, Manoj Manjhi and Manjit Vishwakarma. Name of this petitioner has come in the last column of the First Information Report stating that this petitioner is also involved in the aforesaid

Patna High Court Cr.Misc. No.64712 of 2018 (2) dt.26-10-2018 2/2 act of sale and purchase of stolen motorcycle. From the written report itself, it appears that there is no recovery of any motorcycle from possession of the petitioner. His name has been disclosed by the persons, who were arrested by the police along with motorcycle.

It is mentioned in para 3 of the bail petition that petitioner has clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 1st, Gaya, in connection with Wazirganj P.S. Case No.249 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
