The present application has been filed for modification of the order dated 16.01.2017 passed in Cr. Misc. No. 1181 of 2017 by which the petitioners were granted anticipatory bail in connection with Kazi Mohammadpur P.S Case No. 188 of 2016 for the offences under Sections 147, 148, 149, 323, 337, 338, 307, 379 and 504 of the Indian Penal Code, pending in the court of learned A.C.J.M.-cum-Sub Judge-1st, Muzaffarpur and the petitioners were directed to surrender in the court below within a period of six weeks and furnish bail bonds.

It is submitted on behalf of the petitioner that due to some unavoidable reason the petitioner no.9, namely Md. Avid @ Avid Kuraishi could not surrender and furnish bail bond in the

Patna High Court Cr.Misc. No.21534 of 2017 (2) dt.03-05-2017 2/2 court below well within time.

It is further prayed on behalf of learned counsel for the petitioner that time of surrender may be extended so that the petitioner could surrender in the court below and furnish bail bond.

Considering the submissions made on behalf of learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner in the court below is extended for a further period of three weeks from the date of receipt/production of copy of the order. The order dated 16.01.2017 passed in Cr. Misc. No. 1181 of 2017, is modified to the extent as indicated above. The modification application is, accordingly, disposed of.
