The petitioner seeks bail in connection with Mushahari P.S. Case No. 149 of 2018 (G.R. No. 4171 of 2018) instituted for the offence under Section(s) 399/402 of the Indian Penal Code and Section 25(1-b)A/26 of the Arms Act. It is alleged that petitioner was arrested while making preparation for commission of dacoity along with other accused persons. Police has prepared the seizure list. From perusal of the seizure list, it appears that one iron cutter and a mobile of Samsung company has been recovered from possession of this petitioner. It has further been submitted that other accused of this case has already been granted regular bail by this Hon'ble Court by order dated 28.9.2018 passed in Cr.

Patna High Court Cr.Misc. No.68184 of 2018(2) dt.28-11-2018 2/2 Misc. no. 56791 of 2018.

Petitioner is in custody since 25.6.18 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-6th, Muzaffarpur, in connection with Mushahari P.S. Case No. 149 of 2018 (G.R. No. 4171 of 2018), subject to the condition that both the bailers shall be the close relative of the petitioner (Sanjay Priya, J) shyambihari/- U T
