JUSTICE PARTHA SARTHY ORAL ORDER 11-11-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Sanhaulla P.S. Case No. 134 of 2018 registered under sections 376 and 511 of the Indian Penal Code and section 8 of the POCSO Act.

As per allegation in the FIR, the petitioner is alleged to have sexually assaulted the five year old minor daughter of the informant.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and concocted. The petitioner, who is an old man, aged about 70 years, is a neighbour of the informant and has been falsely

Patna High Court CR. MISC. No.19054 of 2020(7) dt.11-11-2020 2/2 implicated for oblique reasons. The petitioner is in custody since 15.9.2018 and has no criminal antecedent.

The application for bail is opposed by learned APP for the State.

Case diary called for the case, has been received. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the five year old minor daughter of the informant supporting the allegation as levelled against this petitioner by her mother in the FIR, the Court is not inclined to enlarge the petitioner on bail and, as such, the application is rejected. It is submitted by learned counsel for the petitioner that charge has been framed in the case on 21.2.2019. The learned trial Court is directed to expedite the trial. (Partha Sarthy, J) sushma/- U T
