The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 366A and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that petitioner along with the accused persons kidnapped his minor daughter on 04.08.2022 with an intention to marry her.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that the victim has come back and has not supported the case of the prosecution in her statement recorded
Patna High Court CR. MISC. No.22066 of 2023(2) dt.11-07-2023 2/2 under Section 161 of the Cr.P.C. It is further submitted that though it is alleged that victim is a minor, but then she is aged about 17 years and had reached the age of discretion and in her statement recorded under Section 161 Cr.P.C, she has stated that she, on her own volition, had left for Ludhiana. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner and the fact that petitioner is a person with clean antecedent, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Ramgarh P.S. Case No. 276 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
