The application is for grant of bail for the offence under Sections 307/34 of the Indian Penal Code as well as Section 27 of the Arms Act.

It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR and his name transpires only on the basis of confessional statement of the co-accused, who has been granted bail by this Hon'ble Court, vide order dated 02.12.2016 passed in Cr. Misc. No.52078 of 2016 and the petitioner is in custody since 12.09.2016.

Having heard both sides. In view of the facts as stated above that the co-accused, having similar allegation, has been granted bail, let petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of CJM, Nalanda in connection with Bihar P.S. Case No.322 of 2016.
