Heard the parties in virtual Court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a)(c),36,38 of Bihar Prohibition and Excise Act, Section 25(1-b)a, 26,35 of the Arms Act and Section 120(b) of IPC.

Recovery of liquor is alleged from Baba Rice Mill. The petitioner is not owner of the Rice Mill, however, petitioner and others were apprehended at the place of recovery. Petitioner has got no criminal antecedent. Investigation of the case is already complete.

Considering the facts aforesaid, let the petitioner, above named, who is in custody since 28.01.2021, be released

Patna High Court CR. MISC. No.30698 of 2021(2) dt.22-10-2021 2/2 on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nasriganj Police Station Case No.18 of 2021 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
