Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 302, 379, 504 and 506 of the Indian Penal Code and 27 of the Arms Act.
As per the prosecution case, on 09.10.2021 at about 6.00 pm, when informant along with her husband was returning home after shopping from Jamui, then the accused persons including the petitioner assaulted the husband of the informant with lathi, rod, Bhujali, sword and pistol due to which he died.
Patna High Court CR. MISC. No.22254 of 2022(2) dt.12-10-2022 2/2 Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that the petitioner has been made accused in this case due to land dispute and the allegation against the petitioner is of firing on the right leg of the deceased. It is further submitted that the post-mortem report does not corroborate the allegation of the firearm injury on any part of the body. Further, it is submitted that the petitioner is in custody since 11.10.2021, charge-sheet has been submitted in the case and has clean antecedent.
Learned A.P.P for the State opposes the prayer for bail of the petitioner.
Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Sikandra P.S. Case No. 279 of 2021.
