JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 09-08-2023 Heard Mr. Pramod Mishra, learned counsel appearing on behalf of the petitioner and Mr. Rabindra Kumar Priyadarshi, learned counsel for the respondents.

2. Learned counsel appearing on behalf of the petitioner submits that the petitioner has filed a detailed representation for grant of relief as prayed for in the present writ petition. However, the Municipal Commissioner, Gaya Municipal Corporation has not taken any action on the representation filed by the petitioner. Learned counsel further submits that family pension is applicable to the widow of the deceased employees of the Gaya Municipal Corporation and the petitioner is required to be given equal treatment as has been given to other widow of the deceased employees of the Gaya

Patna High Court CWJC No.6210 of 2023 dt.09-08-2023 2/2 Municipal Corporation. In this regard, he seeks to file a fresh detailed representation along with law governing with respect to grant of family pension to the widow of the deceased employees of the Gaya Municipal Corporation.

Considering the aforesaid submission, if the petitioner files a detailed representation, the Municipal Commissioner, Gaya is directed to dispose of the representation of the petitioner within a period of six weeks from the date of filing of the representation and make payment of all the admissible dues including family pension within the aforesaid period in accordance with law after giving specific finding as to whether similarly situated persons have been granted family pension and Rules governing in this area.

4. The writ application, accordingly, stands disposed of.
