JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 19-01-2022 Heard both sides through virtual court proceedings. The petitioner apprehends his arrest in connection with Excise Case No.48 of 2020, registered for the offences punishable under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act.

On the basis of confidential information, the house of the petitioner was raided and 420 Kgs. of Jawa Mahua and 4 litres of Chulai wine was recovered from the place of occurrence.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that nothing has been recovered from the conscious possession of the petitioner.

Patna High Court CR. MISC. No.30328 of 2021(2) dt.19-01-2022 2/2 Recovery has been made from the lane just adjacent to the house of the petitioner. It is further submitted that the petitioner has no manner of concern with the seized liquor or Jawa Mahua.

Learned APP for the State opposes the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.
