2. The petitioners seek bail in connection with Chautham P.S. Case No. 13 of 2024 instituted for the offences punishable under Sections 341, 323, 307, 34 of the Indian Penal Code.

3. As per F.I.R., the allegation against the petitioners is of assaulting the informant on his head by sharp arms with intention to kill him.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. They

Patna High Court CR. MISC. No.24798 of 2024(2) dt.05-04-2024 2/2 have falsely been implicated in this case due to land dispute. There is case and counter case between both the parties. They are languishing in judicial custody since 17.01.2024.

5. Learned APP for the State has vehemently opposed the prayer for bail.

6. From perusal of the F.I.R., impugned order dated 27.02.2024 and injury report submitted on behalf of the petitioners, it appears that on the basis of written report of the informant F.I.R. registered against all the three accused persons and unknown. The specific allegation against petitioner no.1 Anurag Kumar that he attacked upon the head of informant with a sharp arm but there is no allegation of repeated blow. Petitioner nos.2 and 3 have not injured to the informant. As per injury report, only one injury has been found which is simple in nature, accordingly the prayer for bail of the petitioners is allowed. Let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria in connection with Chautham P.S.
