Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 420, 467, 468 and 471 of the Indian Penal Code, registered in connection with Ara Town P.S.Case No.37 of 2021.

As per allegation, the petitioner after producing forged insurance papers became successful in getting his vehicle released, which was seized in Sahpur P.S.Case No. 184 of 2011. The learned counsel for the petitioner has submitted that the petitioner is innocent. The real fact is that the insurance agent Surendra Prasad, son of Mohan Sah had given that insurance policy and it was not within the knowledge of the present petitioner that insurance policy given by Surendra

Patna High Court CR. MISC. No.30763 of 2021(2) dt.21-03-2022 2/2 Prasad was fake one. He has already filed Complaint case No. 1256-C of 2019 in the court of CJM, Bhojpur, Ara against said Surendra Prasad, copy whereof has been annexed as Annexure2. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara, Bhojpur in connection with Ara Town P.S.Case No.37 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
