The petitioners apprehend their arrest in Pasraha P.S. Case No. 57 of 2015, registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code. The informant alleged that the petitioners came having armed with sticks and pistol and abused the son of the informant. Anjar Mandal is said to have fired.
It is submitted that there is land dispute between the parties. Nobody got injured. No assault was made. No empty cartridge was found on the place of occurrence and the false case
Patna High Court Cr.Misc. No.38778 of 2015 (3) dt.09-11-2015 2/2 is filed only account of land dispute.
It appears that there is no allegation of assault against the petitioners. Petitioner no. 4 is said to have fired. Considering the facts aforesaid, petitioner nos. 1, 2 and 4 above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Ravi Ranjan, Judicial Magistrate 1st Class, Khagaria in connection with Pasraha P.S. Case No. 57/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
