The petitioners apprehend their arrest in Surajgarha P.S. Case No. 239 of 2016 instituted for the offence under sections 341, 323, 385, 307, 379, 504/34 of the Indian Penal Code. It is submitted that there is specific allegation in the written report against co-accused Praveen Yadav, who is not petitioner in this case. There is general and omnibus allegation against these petitioners.
From the written report, it appears that there is specific allegation against Praveen Kumar of causing injury on the head of the informant with iron rod
Patna High Court Cr.Misc. No.10067 of 2017 (2) dt.09-03-2017 2/2 It is mentioned in para 3 of the bail petition that these petitioners have clean antecedent.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners named above, within six weeks from today, in connection with Surajgarha P.S. Case No. 239 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, subject to the conditions as laid down under Section 438(2) Cr.P.C.
