Informant had alleged that Surendra Rai @ Chikhri, Yogendra Rai, Niraj Rai @ Buddha, Birendra Rai, Munna Rai came at his Darwaja and made indiscriminate firing whereupon his aunt Mandita Kunwar sustained firearm injury. She was taken to PMCH where was declared dead. At the time of consideration of bail petition of Yogendra Ray @ Yogendra Ram, Birendra Ray @ Birendra Ram under Cr. Misc. No.1154 of 2015, case diary was gone through and further found that the witnesses had alleged omnibus allegation against all the accused persons but contrary to it single corresponding injury caused by firearm was detected during course of postmortem.

That being so, petitioner Neeraj Rai @ Budha Rai is directed to be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.33536 of 2016 (2) dt.17-08-2016 Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Shahpur (Bahoranpur) P.S. Case No.236 of 2014.
