JUSTICE SANJAY PRIYA ORAL ORDER 09-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in East Colony P.S. Case No. 48 of 2016 initiated for the offence under Section-366A of the Indian Penal Code and 6 of the POSCO Act. As per written report, this petitioner was giving tuition to minor daughter of the informant for the last three years. It is alleged that he enticed the daughter of the informant on 01-102016 for the illegal act. It is further alleged that earlier on 28-092016, this petitioner has enticed the minor daughter of the informant but due to pressure of the police, he left the girl. The statement of victim has been recorded u/S 164 of the Cr.P.C. wherein, she has levelled specific allegation against the petitioner of kidnapping her and also of committing illegal act with her. The

Patna High Court Cr.Misc. No.16056 of 2017 (2) dt.09-05-2017 2/2 girl has stated her age as 14 years and the court also assessed her age as 14 years.

In such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly prayer for anticipatory bail of the petitioner stands rejected. The petitioner is directed to surrender in the court below and seek regular bail which shall be considered and disposed off in accordance with law without being prejudiced by this order.
