JUSTICE ARVIND SRIVASTAVA ORAL ORDER 28-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in connection with Tr. No. 211 of 2016 registered under Sections 302,120(B)/34 of the Indian Penal Code pending in the Court of Judicial Magistrate 1st Class, Muzaffarpur.

Learned counsel for the petitioner submits that petitioner is innocent. The deceased was a notorious criminal and was killed by rival gangsters.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that the petitioner is main accused and there is specific allegation against him of firing.

Patna High Court Cr.Misc. No.1679 of 2017 (3) dt.28-02-2017 Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. (Arvind Srivastava, J) Prakash/- U
