JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in ST Excise case No. 549 of 2018 arising out of Nirmali P.S. Case No. 97 of 2018 instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2016.

It is alleged in the written report that 1200 liters of Nepali liquor from a pick up van standing at the door of Rajendra Yadav has been recovered.

Counsel for the petitioner submits that petitioner is son of Rajendra Yadav from whose door it is alleged that pick up van loaded with Nepali liquor has been recovered. The seizure list is part of the First Information Report. It is mentioned in the seizure list that recovery is made from the door of Rajendra Yadav.

Patna High Court Cr.Misc. No.66271 of 2018 (2) dt.06-11-2018 2/2 Counsel for the petitioner further submits that seizure list does not bear signature either of the petitioner or any of his family members.

Petitioner is in custody since 8.8.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Judge (Excise), Supaul, in connection with ST Excise Case No. 549 of 2018 arising out of Nirmali P.S. Case No. 97 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
